GENERAL TERMS AND CONDITIONS FOR USING PARKING IN VELIKO TARNOVO MALL

SECTION I. GENERAL PROVISIONS
Art. 1. These General Terms and Conditions govern the terms and conditions for using parking located on the territory of the Veliko Tarnovo MALL. By entering the territory of the Parking, each User is deemed to be unconditionally familiar with and agree with these General Terms and Conditions and is obliged to comply with them in full.
Art. 2. In the event of any deficiencies in the General Terms and Conditions, the norms of the applicable civil legislation, the Road Traffic Act, the Roads Act and the Regulations for the Implementation of the Roads Act, Ordinance No. 18 of 23.07.2001 on road signaling with road signs, as well as the Personal Data Protection Policy of the Veliko Tarnovo MALL.
Art. 3. For the purposes of these General Terms and Conditions:
(1) "Operator" is "AGI - BRI Participations 3" EOOD, UIC 202342467, owner and manager of the Parking Lot.
(2) "Parking Lot" are areas with controlled access, marked and designated for parking within the Veliko Tarnovo Mall, organized in private property, namely - parts of a building with cadastral identifier 10447.502.80.17 and a property with cadastral identifier 10447.502.80, owned by the Operator.
(3) "User" is any natural or legal person who uses the Parking Lot with a road vehicle.
(4) "Parking Space" is a designated parking space located on levels 0, 1 or 2 in the Parking Lot, delimited by lines perpendicular to the traffic lanes marked on the road surface with yellow paint.
(5) "Visitor parking spaces" are parking spaces available to a wide range of Users in compliance with the tariff under Art. 17 of these General Terms and Conditions.
(6) "Office parking spaces" are parking spaces reserved for vehicles of the Operator and contractors of MALL Veliko Tarnovo, marked in an appropriate manner.
(7) "Subscription parking spaces" are parking spaces available to employees of commercial establishments in MALL Veliko Tarnovo on the basis of a contract concluded with the Operator for a monthly subscription payment based on specified vehicle registration numbers.
(8) "Disabled parking spaces" are specially marked parking spaces intended for vehicles transporting disabled persons holding a preferential parking card under the Road Traffic Act.

(9) "Vehicle" is a road vehicle within the meaning of the Road Traffic Act.
Art. 4. The purpose of these General Terms and Conditions is to establish the efficient use of existing parking spaces, to ensure free and safe movement of vehicles in the Parking Lot, to regulate the movement and stay of vehicles on the territory of the Parking Lot and to determine the rights and obligations of the Users.
Art. 5. The Operator has the right to determine at its discretion the rules for using the Parking Lot, including to deny access to the Parking Lot to both different types of vehicles and specific vehicles, without having to provide an explanation. The Operator has the right to restrict access to certain parking spaces. In this case, Users are not allowed to park there, and the restriction is marked in an appropriate and recognizable manner.

SECTION II. ACCESS TO THE PARKING LOT AND OPERATION MODE
Art. 6. The Parking Lot is open for access around the clock, without restrictions on the number of entries and exits of a given User within the day. The Operator has the right to determine periods in which access to the entire Parking Lot or parts of it is limited, when objective reasons or the need for hygienic or technical maintenance require this.
Art. 7. During snowfall, parking on uncleaned and unsanded outdoor parking spaces is not allowed in order to prevent incidents and ensure the safety of Users.
Art. 8. Access to the Parking Lot is via the entrances on levels 0, 1 and 2, equipped with barriers at each entry point. Video cameras are installed on the barriers that scan the vehicle registration number upon entry and exit for the purposes of access control and recording the duration of stay.
Art. 9. Users are not allowed to enter the Parking Lot immediately after another vehicle if the video camera on the barrier has not scanned the license plate number of the vehicle they are driving. Drivers should ensure sufficient distance between the preceding vehicle and the vehicle they are driving for correct scanning of the license plate number and determination of the access mode. Damage caused to a vehicle as a result of hitting the barrier due to an intentionally shortened distance for the purpose of unauthorized access to the Parking Lot is not subject to compensation by the Operator.
Art. 10. Access, parking and staying on levels 0, 1 and 2 of the Parking Lot (underground part) are prohibited for Users driving vehicles with automatic gas systems (AGU) or vehicles with a height of more than 207 cm. In case of damage caused to the Operator or a third party or in case of sanctions imposed by control authorities as a result of failure to comply with this prohibition, the Vehicle User bears full responsibility.
Art. 11. Leaving the Parking Lot is possible only after paying the parking fee, if such is due according to these General Terms and Conditions. The Vehicle must leave the Parking Lot within 15 minutes after paying the due fee. In case of delay, the User shall pay a new fee for the new hour of parking started according to the applicable tariff.

SECTION III. PARKING RULES
Art. 12. Each User is obliged to park a Vehicle correctly so that it occupies one of the parking spaces designated for parking and not to prevent the occupation of parking spaces in the immediate vicinity by other Vehicles. The User is obliged to park a Vehicle only and exclusively in the designated parking spaces marked in the Parking.
Art. 13. It is prohibited to park a Vehicle outside the places expressly designated for this purpose, including on roadways and passages, in front of emergency exits, in front of storage rooms or technical service rooms, as well as to occupy more than one parking space at the same time.
Art. 14. Users are not entitled to park in parking spaces reserved for people with disabilities, unless they hold preferential parking cards for vehicles transporting people with disabilities, issued under the Road Traffic Act. These Users are obliged to place the card in a visible place on the windshield of the vehicle throughout their stay in the Parking Lot. In all cases, the disabled persons in whose name the cards were issued must have been in the vehicle upon entering the Parking Lot, whether as a driver or as a passenger. The use of parking spaces reserved for people with disabilities is subject to the paid parking regime defined herein and the preferences for free parking in parking lots for public use are not applicable.
Art. 15. Parking spaces for official use are reserved for the Operator’s vehicles and are duly marked. Users are not entitled to park in these spaces without express permission from the Operator.
Art. 16. Parking spaces for use against a subscription are available to employees of commercial establishments in MALL Veliko Tarnovo on the basis of a contract concluded with the Operator for a monthly subscription fee. Access to these parking spaces is based on vehicle registration numbers previously registered in the system. For vehicles that are not registered in the subscription parking system, the general rules and parking tariff under Section IV of these General Terms and Conditions apply.

SECTION IV. TARIFF AND METHOD OF PAYMENT
Art. 17. The fee for using a parking space in the Parking is determined according to the following tariff: a stay of up to 1 hour is free of charge; the parking fee for each subsequent started hour of stay, regardless of the duration of the stay, is until 31.12.2025 – 2 /two/ leva, and from 01.01.2026 – 1 /one/ euro. The applicable parking tariff includes VAT.
Art. 18. For one calendar day within only one visit for the same day, the User is entitled to 1 hour of stay without paying a fee. This free stay is valid only for one entry/exit per calendar day and is not calculated cumulatively; after exit, the free stay for the relevant day is considered to have been used. If a Vehicle stays in the Parking for more than one calendar day, the free stay is counted only for the day on which the Vehicle entered the Parking.

Art. 19. The usage fee is charged after the free period has expired. A parking fee is due for each new hour started, regardless of how much of it is actually used. After paying the due fee, the right to park is terminated and the User is obliged to leave the Parking within the period under Art. 11 of these General Terms and Conditions.
Art. 20. The Operator may determine periods with free access to the Parking at its discretion. In order to ensure free exit from the Parking within these periods, the Operator should place information in a prominent place regarding the end of the free access period, after which a fee for use will be due again.
Art. 21. The parking fee is paid through the payment terminals located at the exits of the Parking Lot at the barriers on levels 0, 1 and 2, by bank card (Visa, Mastercard, Debit), or through a payment machine located in the commercial facility on level 1 in front of the New Yorker store, accepting banknotes with a denomination of 10, 20 and 50 leva, as well as coins of 50 stotinki, 1 and 2 leva, or through a QR code that the User scans and pays online after entering the vehicle registration number through the platform of the barrier manufacturer and a licensed payment operator (myPOS) through a secure channel.
Art. 22. Within a reasonable technical period after the introduction of the euro, the cash payment processing machine may temporarily cease to operate for the purpose of its reconfiguration to accept and process payments in euros. During this period, Users should use other available payment methods.

SECTION V. OBLIGATIONS AND PROHIBITIONS FOR USERS
Art. 23. Traffic in the Parking Lot is regulated by road signs, and if necessary, by specific orders of the Operator's employees or the security company. Users are obliged to comply with the road signs and instructions of the Operator's employees.
Art. 24. Users undertake not to use the Parking Lot for dangerous, illegal, unethical activities or for begging, not to use the Parking Lot for the purpose of vehicle repair, car maintenance activities or other similar activities, not to organize political or public meetings, strikes, performances or commercial activities, as well as not to organize sports or other similar activities on the territory of the Parking Lot.
Art. 25. Users undertake not to carry out actions that may disrupt public order, cause damage or inconvenience to the Parking Lot or its Users, not to leave animals or dangerous substances in vehicles unattended, not to leave minors unattended in the Parking Lot or in parked vehicles, not to use horns without extreme necessity and not to park vehicles with a running engine.
Art. 26. Users undertake not to initiate or participate in competitions on the territory of the Parking Lot, to maintain the cleanliness of the Parking Lot and to dispose of waste in the designated areas, not to perform maneuvers that may be dangerous for other road users, and not to damage the Parking Lot or its elements.

Art. 27. Users undertake not to leave the territory of the Parking Lot without having paid the due parking fee, as well as not to enter or exit through the Parking Lot barriers after another vehicle before the barrier falls, in order to avoid paying the due fee or for the purpose of unauthorized access.
Art. 28. All damage caused to their own vehicles, as well as to other vehicles or facilities by Users while driving or parking in the Parking Lot, shall be borne entirely by the guilty parties, and the Operator shall be released from any liability in this regard.

SECTION VI. OPERATOR'S LIABILITY
Art. 29. The Parking Lot is not a guarded parking lot within the meaning of the law. The Operator shall not assume any obligation to store the vehicles or the items contained therein, nor shall it be liable for their integrity and security.
Art. 30. Video surveillance is organized on the territory of the Parking Lot in order to establish violations of these General Terms and Conditions, establish and document damages and injuries, as well as to protect property and public order. Video recordings are used only for these purposes and are provided to the Ministry of Internal Affairs, the Prosecutor's Office, the court and other competent authorities upon due request. If a violation is reported and a video recording is available, the Operator prepares a copy for the purposes of presentation to the competent authorities.
Art. 31. The Operator is not liable for theft of a vehicle or items from a vehicle committed by third parties, nor for damage to a vehicle caused by third parties. In these cases, claims should be directed to the relevant perpetrator, with the Operator assisting in establishing the violation within the capabilities of video surveillance and in accordance with the applicable legislation on the protection of personal data.

SECTION VII. VIOLATIONS AND CONSEQUENCES
Art. 32. A violation of these General Terms and Conditions is considered to be stopping or parking a vehicle in places other than those designated and marked, occupying more than one parking space, parking in front of evacuation routes, improper parking in places intended for people with disabilities without such a right, parking in places for official use or places for use against a subscription without the relevant right, as well as the unethical and rude attitude of a driver of a vehicle towards a third party, including an employee of the Operator, the security company or the administration of the Operator on the territory of the Parking Lot, or violation of the prohibitions under Art. 24, 25, 26 and 27 of these General Terms and Conditions.
Art. 33. In case of violations, the Operator's employees place notification (indicative) stickers on the windshield of the vehicle for informative purposes regarding the violation committed. The registration number of the vehicle for which a violation has been found is entered into a list of violators, which can be used to restrict the access of the relevant vehicle to the Parking Lot in the event of repeated or systematic violations.

Art. 34. A vehicle parked for more than 7 consecutive calendar days is considered abandoned. The Operator has the right to immobilize such a vehicle in an appropriate manner, including by installing a blocking device or by calling a specialized evacuation company, and notifies the competent authorities about the abandoned vehicle in accordance with applicable legislation.

SECTION VIII. PROTECTION OF PERSONAL DATA
Art. 35. The Operator processes personal data of Users in accordance with Regulation (EU) 2016/679 (GDPR) and the Personal Data Protection Act. Details regarding the processing of personal data, the purposes, the legal basis, the rights of data subjects and the methods for exercising them are regulated in the Personal Data Protection Policy of MALL Veliko Tarnovo, which is available on the website www.mallvt.bg and at the security company of MALL Veliko Tarnovo.

Art. 37. These General Terms and Conditions are published on the website https://mallvt.bg/bg/parking and are available from the security company of MALL Veliko Tarnovo. Stickers with a QR code for scanning and access to the General Terms and Conditions are located on the barriers, payment points and in other places in MALL Veliko Tarnovo. For the convenience of Users, the General Terms and Conditions are printed and publicly available on each underground parking level.

SECTION X. FINAL PROVISIONS
Art. 38. The General Terms and Conditions are interpreted and applied in accordance with the current Bulgarian legislation. In the event of disputes related to the application or interpretation of the General Terms and Conditions, the court at the registered office of the Operator shall have jurisdiction.
Art. 39. The Operator reserves the right to amend these General Terms and Conditions at any time. The amended General Terms and Conditions shall enter into force on the day of their publication on the Operator’s website and in prominent places in the Parking Lot, unless otherwise provided therein. Use of the Parking Lot after the entry into force of the amended General Terms and Conditions shall be deemed to be unconditional acceptance of the amendments by the User.
Art. 40. The provisions of these General Terms and Conditions shall also apply to vehicles for supply or deliveries, as well as to taxis, except in cases where the Operator has provided special conditions for access to such vehicles.
Art. 41. These General Terms and Conditions shall enter into force on 06.12.2025.
